SC transfers cheating case against choreographer Remo D’Souza to Delhi court – ThePrint – PTIFeed

New Delhi, Nov 22 (PTI) The Supreme Court on Friday transferred the trial in a cheating case involving ace Bollywood director and choreographer Remo D’Souza to Karkardooma courts in Delhi.

A bench comprising Justices Surya Kant and Ujjal Bhuyan said no serious prejudice would be caused to the prosecution if the case was shifted from Ghaziabad to a court in the national capital.

The apex court said that the chief metropolitan magistrate at the Karkardooma courts is free to assign the case to the concerned judge.

On November 15, the apex court had issued notices to the UP government and Ghaziabad-based businessman Satyendra Tyagi in the scam case.

The case dates back to 2016 when Tyagi filed an FIR against D’Souza.

The FIR alleged that D’Souza convinced Tyagi to invest Rs 5 crore in his upcoming film ‘Amar Must Die’ with the promise of doubling the amount invested after its release.

However, the businessman claimed that the promise was not honoured.

The FIR – under Sections 420 (cheating), 406 (criminal breach of trust) and 386 (extortion) of the IPC – further alleged that when Tyagi sought his money, D’Souza threatened him by framing don Prasad Pujari to intimidate him.

The Additional Chief Judicial Magistrate, Ghaziabad, took cognizance of the offense in October 2020, which D’Souza challenged in the Allahabad High Court and sought a stay of proceedings.

However, on 23 August 2023, a bench of Justice Rajeev Misra of the Allahabad HC rejected his plea and noted that D’Souza had not contested the charge sheet filed in the case, making it impossible for the court to grant him exemption.

The high court accepted D’Souza’s appeal on November 21 and issued the notices, posting the hearing on Friday.

D’Souza, born Ramesh Gopi Nair on 2 April 1974, is part of the entertainment industry and is a renowned choreographer, director and film producer.

With a career spanning over 25 years, he has choreographed over 100 films, gaining widespread acclaim as one of Bollywood’s most successful and innovative choreographers.
